The prevalence of traumatic brain injury (TBI) and increased risk of criminal justice system involvement among the U.S. veteran population warrants a greater understanding of jurors' level of knowledge regarding TBI. However, research has focused on the public's misconceptions and misattributions or on providing jurors with educational material about TBI. This study is a secondary data analysis of an original research study that investigated a sample of 755 participants randomly assigned to vignettes regarding a case summary of a veteran defendant. This study then investigated a subset of participants randomly assigned to a veteran defendant that had sustained a TBI. Using a survey of basic TBI facts explicitly designed for this study to test participants' knowledge, the study examined how the public's knowledge of TBI influences the punitiveness of their judgments and how the public's confidence in their knowledge impacts the sureness of their decision-making. Additional exploratory analyses were performed to find possible predictors of TBI knowledge. A significant relationship was found between participant confidence in their TBI knowledge and their sureness when determining guilt, r(319) = .137, p < .05. Additionally, significant differences were found in TBI knowledge along income groups, F(6,748) = 2.098, p = .05. Future directions for research should include further investigation of how to appropriately measure the public's knowledge regarding TBI as well as what areas of knowledge jurors should be educated on to make informed decisions regarding veteran defendants.
