There is considerable variation across the American states as to how judges are selected for the bench, and how they retain these seats. There is also variation across the states in the legal codes that guide judicial conduct on the campaign trail as well as on (and off) the bench. When and why do these rules for judicial selection and conduct change? The composition of a state judiciary is impacted by decisions of the state legislature and the state legal community. The state legislature creates policy that shapes judicial selection in that state, while the legal community, specifically the state bar association, creates a judicial code of conduct for each state judiciary. What factors cause change in state judicial policy? In this dissertation, I explore this topic. I answer the following research questions: 1. What motivates a state to change its rules that shape how judges are selected? 2. What motivates a state legal community to change its rules that govern judicial conduct? My general argument is that that these changes occur in response to several state-specific factors. These factors include judicial misconduct, judicial campaign contributions, and a state's political environment. My analysis provides clarity on why judicial policy changes do and do not occur.
