This study is a critical reflection about the 'scientific' approach to urban planning in the context of developing countries, and Brazil in particular. It first examines the usefulness of such an approach to the Third World reality, and tries to assess the extent to which it in fact contributes to the degradation that one sees. The study then considers what sort of structural refonns might be undertaken to change this chaotic situation, with particular emphasis on public participation in the planning process. In our view, this is an important measure to respond to one ofthe leading causes ofsocio-spatial exclusion in southern cities: that is, alienation of the public from the planning process. Two concrete examples of public participation are examined as case studies: the procedure provided under the Planning Act of Ontario, Canada, and the participatory budget planning process practised in Porto Alegre, Brazil. We conclude with some observations about trends in planning law in the face ofthe phenomenon ofglobalization.

520 $a La presente etude se veut une reflexion critique sur l'approche dite «scientifique» de la planification urbaine dans des pays en developpement, prenant comme exemple le Bresil. Nous examinons d'abord l'utilite d'une telle approche dans le contexte urbain particulier de ces pays, afin d'evaluer dans queue mesure elle contribue en fait a la degradation urbaine evidente. Nous considerons ensuite les reforme structurelles possibles pour repondre a la situation chaotique existante, notamment la question de la participation publique dans le processus de planification. A notre avis, une telle mesure est importante pour contrer l'une des causes principales de la segregation socio-spatiale dans des villes du sud, a savoir: l'alienation du publique dans le processus de planification. Nous examinons de pres deux exemples de participation publique: celle prevue par la Loi sur l'amenagement du territoire de l'Ontario, Canada, et celle de la planification budgetaire participative de Porto Alegre, Bresil Nous terminons avec quelques observations sur les tendances actuelles en droit urbain face au phenomene de la globalisation.
