Under the Administrative Procedure Act (APA) of 1946, federal agencies can invite public comments on proposed rules before they become binding as law and public policy. However, inconsistency continues to negatively affect the agency approach. The resulting policy ineffectiveness impacts social justice and societal issues observed in the consumer protection policy areas, including consumer information, e-financial services, and product safety. Multi-agency studies evaluating the rulemaking support for diversity and equality using Benet's polarities of democracy theory were absent. Therefore, the study purpose was to use content analysis to improve the understanding of whether the Federal Trade Commission, Consumer Financial Protection Bureau, and Consumer Product Safety Commission's rulemaking approach to consumer protection in their 2010-2020 Federal Register policy documents advanced or impeded achieving the positive aspects of diversity and equality as democratic values. It was found that while the agencies attained the positive aspects around the invitation and receipt of comments, non-inclusive deliberation caused a negative infinity loop of unsustainable success. The results might be useful for agencies to identify the facilitators and barriers to democratic rulemaking that could support addressing the inconsistencies across federal agencies. It is recommended that the government recreate the Regulation Room and adopt the theory as the cohesive standard for democratic rulemaking. Positive social change may emerge from an improved policy practice in federal agencies, starting with the ones studied. Also, public discussion could affect legislative changes that solve the social problem and advance societal democracy.
