The purpose of this research was to examine the challenge of protecting data privacy during a forensic investigation, providing an alternative view to most of the literature that focuses on the collection of bit-by-bit forensic images containing a full view of all available resources on the device. This research focused on the standard evidence collection procedures, data privacy concerns, data privacy laws and regulations, and the recommended privacy protection procedures for forensic evidence collection. Findings revealed that the standard evidence collection procedures do create data privacy concerns and that investigators face potential privacy breaches when collected evidence contains data that belongs to users, clients, or patients outside the purview of the case. The research concluded that protection against privacy violations is necessary as U.S. Courts showed decisively how much public perception changed when personal privacy questions arose in cases. Experts in the digital forensic field implement the changes through the establishment of privacy protecting forensic methodologies and frameworks, educating investigators over current privacy laws and regulations, and further research over privacy protecting or relevant data collection procedures available for digital forensic collection purposes. Through the changes, the digital forensic industry offers a more privacy protecting environment that reduces the chances of privacy violations while increasing efficiency and processing time.
