Research shows that currently in the U.S. about 7.3 million people are under the supervision of the correctional system and of those individuals about one out of every six suffer from some type of severe mental illness. It is evident the jails and prisons within the U.S. have become the de facto mental health solutions for these individuals. Due to this perception this study focused on whether there was a statistically significant relationship between the mental health diagnosis associated with length of sentence while controlling for gender, nature of crime, race, education, age, and employment at time of conviction. Finally, the study determined whether those offenders with an Axis 1 diagnosis received a longer sentence based on the nature of crime. The sample was collected from a pre-existing database of approximately 4,500 total offenders from the years 2010--2013. This study utilized a quantitative methodological approach with a quasi-experimental design. The statistical test used was an ANCOVA. This quantitative methodological approach was implemented to explore differences between the independent variable of psychiatric diagnosis and the outcome variable of sentence length while controlling for the covariates. SPSS was used to run regression analysis on this data removing any variations in the outcome variable. The results demonstrated offenders with a mental health diagnosis received shorter sentences on average so the Null Hypothesis was accepted. However, there was a significant interaction between mental health diagnosis and nature of the crime, so the Null Hypothesis was rejected. The goal is a reduction in sentencing for those with a mental health diagnosis. This can be accomplished by utilizing treatment, community services, diversion and mental health courts for this population as opposed to incarceration.
