This dissertation seeks to establish the accommodation of national diversity as a new aspect of the European integration process that reveals a more nuanced and less unidirectional relationship between the European Union (EU) and its constituent units. Existing integration theories, while disagreeing about the driving forces of the integration process, invariably register further progression as EU competences expand, decision-making rules become more supranational, and its membership grows. Yet, these metrics tell us little about the nature of the policies that the EU produces and, in particular, whether EU legislation exerts strong homogenizing pressures or whether it allows substantial leeway to member states. To address this question, the dissertation analyzes the change over time and across three issue areas in the availability and use of accommodating mechanisms, defined as formal provisions allowing for the divergent application of EU policies.

Relying on textual analysis of legislation and other official documents as well as on unstructured elite interviews, the dissertation presents empirical evidence establishing a variation in the direction of change in accommodation across three largely similar issue areas, all pertaining to the regulation of the internal market and subject to the same decision rules. Thus, successive reforms of food safety statutes have removed important flexibility, previously available to national administrations. In the field of protection of consumer economic interests, the level of accommodation has remained relatively constant. Finally, a new type of accommodating mechanism is being introduced in the regulation of genetically modified organisms.

The analysis identifies the level of contestation and type of involvement as two factors that can account for these different trajectories of development. Findings show that higher levels of contestation result in greater accommodation of national diversity, suggesting that supranational institutions have limited capacity to counteract national pressures for maintaining local specificities. The dissertation also demonstrates that popular involvement in EU policy-making creates new types of demand for accommodation that the EU seeks to meet through the development of novel accommodating mechanisms.

The dissertation concludes that accommodation of national diversity enables progress along other dimensions of the integration process, even if, paradoxically, at times the process goes in the direction of permitting greater flexibility to member states.
